Diagnostic Liability Waiver & Release

Because diagnostics are remote and advisory, vehicle owners acknowledge the risks, assume responsibility for any actions they take, and release The Wrench Bros and the technician from liability for resulting damage, injury, or loss.
1. Nature of remote diagnostic help
I understand that The Wrench Bros connects me with an independent technician who provides ADVISORY guidance remotely, based only on the information I provide. The technician cannot physically see, road-test, disassemble, or inspect my vehicle, and may not have complete or accurate information.
I understand any guidance is informational and is not a definitive diagnosis, a repair, or an instruction that a specific repair is safe or correct for my vehicle.
2. Assumption of risk
I understand that operating, inspecting, troubleshooting, and repairing motor vehicles is inherently dangerous and can result in property damage, serious bodily injury, or death. Knowing these risks, I voluntarily and knowingly assume all risk associated with using remote diagnostic guidance and with any action I choose to take based on it.
3. Release and waiver of liability
To the maximum extent permitted by law, I release, waive, and discharge The Wrench Bros, its owners, employees, and agents, and the technician who assists me, from any and all liability, claims, demands, or causes of action for any damage to my vehicle or other property, personal injury, or financial loss arising out of or relating to the diagnostic guidance or any action or repair I undertake in connection with it — whether or not caused by ordinary negligence.
This release does not apply to liability that cannot be waived under applicable law (for example, gross negligence, willful misconduct, or fraud).
4. No warranty or guarantee of results
I understand that no guarantee is made that the cause of my vehicle's problem will be identified or resolved, and that following the guidance may not fix the issue and could be unsuccessful.
5. My responsibilities
I am solely responsible for deciding whether and how to act on any guidance. I will use appropriate safety precautions, follow manufacturer procedures, and use proper tools and equipment.
I will obtain in-person inspection and service from a qualified, licensed professional before relying on the vehicle, and especially before driving if there is any doubt about safety.
6. Safety-critical and high-voltage systems
I understand that work involving brakes, steering, suspension, fuel systems, airbags/restraints, tires, and high-voltage or hybrid/EV systems is especially hazardous, and that remote guidance is not a substitute for hands-on diagnosis and repair by a qualified professional for these systems. I will not rely on remote guidance alone for safety-critical work.
7. Indemnification
I agree to indemnify and hold harmless The Wrench Bros and the technician from any third-party claims, damages, or expenses (including reasonable legal fees) arising from my actions, my vehicle, or my reliance on diagnostic guidance.
8. If my vehicle may be unsafe
If at any point my vehicle may be unsafe to operate, I will stop using it and seek qualified in-person help. I will not rely on remote guidance in an emergency.
9. Limitation of liability
To the maximum extent permitted by law, the total liability of The Wrench Bros and the technician for any claim relating to a diagnostic is limited to the amount I paid for that diagnostic.
10. Consent to recording of calls
I understand and agree that diagnostic calls on The Wrench Bros are recorded and stored for quality, safety, and dispute resolution. I knowingly and voluntarily consent to the recording of my calls by The Wrench Bros and the technician.
I understand that Washington and some other states require the consent of all parties to record a conversation, and by agreeing to this Waiver and by proceeding with a call after the on-screen recording notice, I give that consent. I will not record a call myself without the other party's consent, and I will not share information on a call that I do not want recorded.
11. Electronic signature and email confirmation
I am signing this Waiver electronically by typing my name. I agree that my typed name is my legal signature and has the same effect as a handwritten signature under the E-SIGN Act and UETA.
I understand and agree that confirming my email address finalizes and makes this Waiver legally binding, and that the platform retains a record of my signature, the date and time, my IP address, and the version of this Waiver.
12. Acknowledgment
I have read this Waiver, I understand it, and I am agreeing to it freely and voluntarily. I understand I am giving up substantial legal rights by agreeing.
